28 44 1838 dispute over the burial of an unbaptised child in a Roman Catholic church grounds. Sworn statements against the Rev. Mr. Nolan, Catholic Curate of Clonegal, Co. Carlow who allegedly stated to Patrick Donnelly that “if he did not raise the Body of the said James Donnelly [the child] he [Rev. Nolan] would raise him himself and throw him to the Pigs”. The statement by the father James Donnelly, Carrignafecka, Lorum, Co. Carlow, who had buried his parents and his son Pat Donnelly in the grave and added his son James later to the plot. Also a further statement from Robert Sherlock of Clonegal where he saw Parick Donnelly of Ballinstraw, John Byrne of Glynn, Co. Carlow andWilliam Doyle of the Watch House, Co. Wexford dig up the remains. Two charge sheets are also included. The case was rejected by the Attorney General (who was not willing to prosecute a priest !). Bizarre. Condition: Very good. According to the Rules of the Roman Catholic Church, which remained in place up to the 1970s, the “unbaptised body” should not have been buried on consecrated ground. (27.9 by 43.2cm) Condition: Laid down to board, framed and glazed, missing 2 by 2 inches piece at top left corner but not into the rext, water stained at lower left, good overall.
