20 History 37 Early 19th century to mid 20th century Last Will and Testament documents (70+) Many original manuscript documents signed (some signed with X mark) by testator and witnesses. Dating from 1777 (earliest) to 1940s, detailing information on families, relationships, instructions, debts, beneficiaries, bequests, executors, provisions, possessions, house property, land ownership and divisions, donations, directions, burial, personal wishes and codicils etc. Quarto to large folio. 12 by 10in. (6) In the 19th Century women were considered inferior to men. This attitude was a deterrent to women in reporting rape. In the six signed affidavits listed here we get a glimpse of the disparate efforts made by the victims in order to resist being raped and the proposals and promises by the perpetrators to avoid justice, names and addresses are recorded on each statement. Condition: Very good. (1) Statement sworn before Magistrate Gilbert Fitz Gerard of MontGerard, Deputy Seneschal of Carlow, dated November 1819. Bridget Bowe sworn affidavit against John Byrne for rape, John “offered her a 40 shilling note and proposed courtship with her if she would not swear against him” (2) Statement sworn before Magistrate Gilbert Fitz Gerard dated August 1806 by Anastasia Hogan against Thomas Borroughs for rape, Thomas said if she did not report the incident and allow him“a free intercourse at his pleasure” he would marry her, later she found “herself with child”. (3) Statement dated October 1806 sworn before Magistrate Gilbert Fitz Gerald by Mary Joyce against Dennis Byrne who “did commit a rape on her body” and when she told him she “would bring him to justice” he told her that “as he was a Tradesman he would have his Liberty in any other Nation the same as in Ireland”. (4) Statement dated February 1815 sworn before Magistrate Gilbert Fitz Gerard by Judith Malone against Walter Cummins. Judith who describes herself “as an innocent country girl” states she was raped by Walter who delayed her swearing against him by promising to marry her. (5) Statement dated December 1806 sworn before Magistrate Gilbert Fitz Gerard by Margaret Murphy against Patrick Kealy for rape. Margaret warned Patrick that she would bring him to justice and he “ promised that if she would not swear against him he would marry her”, she waited until the appointed time of marriage by which date he neglected to marry her. (6) Statement dated July 1806 sworn before Magistrate Gilbert Fitz Gerald by Anstice Cummins against Thomas Hickey who raped her despite her warning him that “she would swear against him before a magistrate” he replied “that he did not care as he did not intend to stay in the country long enough to be taken.
